Since Mohinder was planning in killing Sylar anyway, why not just shoot him and take the spinal fluid afterwards? Alternatively, keep him sedated until after the tests, in case the drugs don't work! Speaking of which, how was he able to overcome those drugs? TPTB were so vague with Sylar's abilities that plot convenience became all too common with him.
